1. Acceptance of Terms
By enrolling your child in STAY AFTER SCHOOL (the “Program”), you (“you” or “Parent/Guardian”) agree to abide by these Terms & Conditions and any other rules, policies or handbooks provided by STAY AFTER SCHOOL (“we,” “our,” “us”). Your child’s continued participation in the Program constitutes your acceptance of modifications to these Terms & Conditions.
2. Program Description
The Program provides after-school enrichment and care services for children. We will perform the services as described in enrollment materials, schedules, and any applicable school/facility agreements. Program offerings, schedules, pricing, and staffing may change at our discretion.
3. Enrollment and Fees
Enrollment is subject to availability and completion of required registration forms, waivers, medical/health information, and payment of fees.
Tuition and fees must be paid according to the schedule set forth in your registration agreement or invoice. Late payments may incur late fees and/or suspension of services.
Enrollment may be cancelled by you pursuant to the cancellation policy (see Section 6) or by us for cause (see Section 8).
We may offer discounts or special pricing (siblings, early registration, etc.); such offers are subject to change or discontinuation.
4. Billing, Late Payment & Suspension
If a payment is not received by its due date, we may charge a late fee, interest or take other collection actions.
We reserve the right to suspend your child’s participation in the Program until all outstanding charges are paid in full.
Fees are non-refundable except as explicitly stated in our policy. Refunds or credits may be granted only in defined circumstances (e.g., Program cancellation by us, as specified).
5. Child Release, Pick-Up & Late Pick-Up
Your child will only be released to individuals you have designated as authorized pick-ups on the registration form, with appropriate photo identification.
If your child is not picked up by the scheduled end time, we may assess a late pick-up fee. Repeated late pick-ups may result in termination of enrollment.
If a non-authorized person arrives, we will attempt to contact you and emergency contacts; if unable to release your child safely, local authorities may be contacted.
6. Cancellation and Withdrawal
You may withdraw your child from the Program by providing [number of days] written notice (or via our registration portal) and by paying any outstanding fees through the notice period, as applicable.
We may cancel your child’s enrollment if you fail to pay fees, submit required forms, or your child exhibits behavior that jeopardizes the safety or quality of the Program.
We reserve the right to cancel or modify the Program (schedule, location, staffing) for any reason (including school closures, facility issues, increased costs). If we cancel the Program, we will notify you and may provide a credit or refund as per our cancellation policy.
7. Health, Safety & Behavior Policies
You must provide accurate and up-to-date health, allergy, medication, and emergency contact information for your child.
We will administer first aid and emergency care as appropriate. If your child is ill (fever, vomiting, communicable disease), we may require you to pick them up immediately.
Your child must adhere to the behavior expectations of the Program (and the host school or facility). Persistent or serious behavioral issues may result in suspension or dismissal from the Program.
We are not responsible for children’s personal possessions (toys, electronics, etc.) brought from home unless explicitly arranged.
8. Termination
We may terminate your child’s participation for cause, including but not limited to: non-payment, repeated late pick-up, failure to complete required forms, unsafe behavior, or violation of these Terms & Conditions.
Upon termination, you may be responsible for any unpaid fees accrued until the effective date of termination. No refunds will be provided for days after termination unless required by law or specified policy.
9. Parent/Guardian Responsibilities
You agree to provide accurate information at registration and update it as needed (child’s health/allergy status, emergency contacts, authorized pick-ups).
You will ensure timely drop-off/pick-up and notify the Program if your child will be absent.
You will adhere to Program rules (including those of the facility or school) and support our staff in providing a safe, respectful environment.
10. Limitation of Liability & Indemnification
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages arising from your child’s participation in the Program.
You agree to indemnify and hold harmless STAY AFTER SCHOOL, its employees, agents and representatives from any claims, damages or liabilities arising from your child’s enrollment or your breach of these Terms & Conditions.
11. Media Release
As part of enrollment you may be asked to provide consent for photographs or video of your child during Program activities. If consent is given, we may use such images for promotional or informational purposes. You may revoke consent by written notice, but previous use will not be reversed.
12. Changes to Terms & Conditions
We may modify these Terms & Conditions at any time by posting a revised version online or providing notice to you. Continued participation after changes constitutes your acceptance of the updated terms.
13. Governing Law
These Terms & Conditions are governed by the laws of the State of Texas. Any dispute arising out of or relating to these Terms & Conditions shall be resolved in the state or federal courts located in Travis County, Texas.
14. Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remainder of the terms shall remain in full force and effect.
15. Entire Agreement
These Terms & Conditions, along with any registration/enrollment form, Program handbook or policies you receive, constitute the entire agreement between you and STAY AFTER SCHOOL regarding your child’s participation in the Program, superseding all prior or contemporaneous agreements.
